Program Terms and Conditions
The Dymocks Booklover Program is operated by Dymocks Franchise Systems (NSW) Pty
Limited ACN 002 989 862 (Dymocks). Each member of the Dymocks Booklover Program
is bound by these Terms and Conditions.
- Each application for membership of the Dymocks Booklover Program is subject to
acceptance by Dymocks in its absolute discretion.
- Dymocks Booklover Program membership is only activated on receipt by Dymocks of
a fully completed and signed application form or by valid registration accepted
through Dymocks Online (www.dymocks.com.au).
- Only individuals can apply for Dymocks Booklover Program membership. Corporations,
partnerships, trusts and other entities are not eligible to participate in the Dymocks
Booklover Program.
- A Dymocks Booklover Program member may only hold one Booklover Card. Booklover
membership and cards cannot be held jointly.
- Employees of Dymocks, of any participating Dymocks company or franchise store,
of Dymocks advertising agency and of Dymocks Booklover Program manager are not eligible
to participate in the Dymocks Booklover Program.
- Five Booklover Points will be earned for every whole dollar spent at a participating
Dymocks store or Dymocks Online on Eligible Purchases. Dymocks may also offer
bonus Points from time to time on terms set by Dymocks in its absolute discretion.
- Booklover Points will be earned with every Eligible Purchase made at any participating
Dymocks store within Australia (except Leichhardt & Sydney Stationery store)
on presentation of a Dymocks Booklover Card, or at Dymocks Online on entry of a
Dymocks Booklover Card number and password details, subject to terms set by Dymocks
from time to time in its absolute discretion.
- A Dymocks Booklover Card must be presented, or Dymocks Booklover Card number and
password details entered at Dymocks Online at the time of sale for Booklover Points
to be earned. Points will only be awarded after a sale is completed upon provision
of an original receipt and Dymocks Booklover Program membership and card details
to Dymocks for processing.
- Booklover Points will be allocated to a Dymocks Booklover Program member account
within 24 hours after each Eligible Purchase, subject to specific promotion terms
and system availability.
- Booklover Points cannot be transferred.
- Active Dymocks Booklover Program members will receive regular Dymocks Booklover
Program communications showing Booklover Points balances.
- Booklover Points balances and other details can be checked at Dymocks Online following
the entry of Dymocks Booklover Card number and password details, subject to system
availability.
- Booklover Points will expire two years after issue. During this time the points
will continue to be available for redemption while the Dymocks Booklover Program
is operating and the relevant Dymocks Booklover Program Member account remains open
and active.
- Booklover Points will not be earned on the purchase of a Dymocks gift card and
cannot be redeemed to buy a Dymocks gift card. However Booklover points may be earned
when using Dymocks gift cards for payment for Eligible Purchases.
- The purchase of Audible.com products is not an Eligible Purchase, and Booklover
points will not be earned on the purchase of Audible.com products.
- The Booklover Program will have Classic and Gold tiers of membership which attract
different entitlements. All new members will be Classic members. To migrate from
Classic to Gold a member must spend $2000 within a consecutive 12 month period.
Dymocks reserves the right to change the tiers of membership, the qualifications
for joining or remaining in a tier and the membership entitlements for each tier,
from time to time.
- Booklover Points are redeemable at the rate of one hundred Booklover Points per
dollar, and can only be redeemed with a minimum of $5 spend (500 points). Dymocks
will endeavour to provide at last 90 days notice of any increase in the points redeemed
per dollar on the minimum redemption.
- Booklover Points are redeemable by presenting a valid Dymocks Booklover Card at
the time of purchase at any participating Dymocks store or enter the Booklover Card
Number and password to make a purchase online.
- Booklover Points can only be redeemed for goods and services sold at participating
Dymocks stores in Australia or at www.dymocks.com.au,
or at other nominated Dymocks Booklover Program partners.
- No change will be given for purchases valued at less than the face value of the
Booklover Points you redeem.
- Booklover Points cannot be redeemed for cash.
- Refunds will only be provided for goods and services purchased using a Dymocks
Booklover Card in accordance with Dymocks refunds and returns policy. In the event
of a refund, any Booklover Points earned for the original purchase will be deducted
from the Dymocks Booklover Program account, and if purchased using redeemed Booklover
Points in partial or full payment, Booklover Points will not be refunded.
- Your membership details are personal information for the purpose of the Privacy
Act.
- Personal information will only be used for the purpose of the Dymocks Booklover
Program and by the Dymocks Group of companies and its franchise owners for marketing
and promotion.
- Dymocks may provide personal information to outside organisations who are contracted
by the Dymocks Group of companies to carry out advisory, administrative or research
functions for Dymocks.
- Your Dymocks Online password must not be disclosed to any other person.
- Dymocks reserves the right to suspend or terminate the Dymocks Booklover Program
at any time by providing not less than 90 days notice to members.
- Membership in the Booklover Program may be terminated immediately by Dymocks if
Dymocks has reasonable grounds to suspect that a Dymocks Booklover Program member
has shop-lifted or defrauded Dymocks or the Dymocks Booklover Program in any way.
- Dymocks may terminate any membership of the Dymocks Booklover Program without
notice, if the relevant member
- fails to comply with these membership Terms and Conditions;
- engages in misleading or deceptive conduct in connection with the Dymocks Booklover
Program; or
- the member does not use his or her membership card for a period of 12 months,
or dies or becomes bankrupt.
A member may terminate his or her membership in the Dymocks Booklover Program at
any time by giving written notice to Dymocks.
- All Dymocks Booklover Program cards remain the property of Dymocks.
- Dymocks may appoint its franchise owners of any participating Dymocks store to
exercise any discretion conferred on Dymocks under these Terms and Conditions.
- Dymocks is not responsible for stolen or lost Booklover Cards.
- To the extent permitted by law, any liability that Dymocks may have to a
member relating in any way to the Dymocks Booklover Program whether for negligence,
breach of contract or otherwise is limited:
- in the case of any claim relating to points, to crediting the relevant number
of points to the member’s account; and
- in any other case, to a maximum of $.01 for each point in the member’s account
at the time the liability arose.
All conditions and warranties, whether express or implied and whether arising under
statute or otherwise, are expressly excluded to the full extent permitted by law.
- Dymocks may make any changes at any time in its absolute discretion, to these
Terms and Conditions. Dymocks will endeavour to provide at least 90 days notice
of any such changes.
- Where Dymocks is required to give notice under these Terms and Conditions, notice
may be given by advertising in the public notice columns in major daily newspapers
in Australia (and other relevant jurisdictions).
